(1) Das am Modell Open Source nachgebildete Konzept Open Content (wobei Open Information oder Open Info eigentlich treffender erscheint) ist relativ neu, was sich unter anderem daran zeigt, das sich alle Lizenzen auf diesem Gebiet noch mehr oder weniger im Entwurfsstadium befinden.
(2) Sämtliche Open Information-Lizenzen orientieren sich sehr stark am Einzeldokument (Open Content Licence, Open Publication Licence oder die von OpenTheory verwendete FSF Free Documentation Licence) oder sind Lizenzen, die ein "compilation copyright" etablieren (Nupedia Open Content Licence, siehe http://www.nupedia.com/licence.html).
(2.1) Nupedia steht unter der FDL, 27.07.2001, 13:33, Benja Fallenstein: Nupedia steht schon länger unter der GNU Free Documentation License: siehe http://www.nupedia.com/license.shtml (der Link im Absatz oben geht inzwischen nicht mehr). Auch Wikipedia, eine auf Wiki basierende Enzyklopädie (d.h., jedes darf mitschreiben und bestehende Texte überarbeiten), steht unter der FDL.
Vorher gab es ein Projekt von der Free Software Foundation (den MacherInnen von GNU), die GNUpedia, teilweise um zu verhindern dass Nupedia unter ihrer bisherigen, restriktiveren Lizenz Erfolg hätten. Nachdem Nupedia unter die FDL gestellt wurde, haben sie ihre eigenen Artikel in Nupedia überführt, damit die Arbeit nicht dupliziert wird.
(3) Eine Lizenz für Sammelwerke, die sowohl eine Privatisierung des Inhalts verhindert, als auch jedem Mitwirkenden gewisse Rechte einräumt, scheint es noch nicht zu geben.
(4) So wird insbesondere der für ein Sammelwerk sehr wichtige Aspekt der Behandlung von Metadaten für die Einordnung der Teile ins Große und Ganze nirgendwo erwähnt.
(5) Als Alternative wäre auch denkbar, die einzelnen Artikel unter einer Lizenz, beipielsweise der GNU Free Documentation License, zu veröffentlichen, darüberhinaus aber die Enzyklopädie als solche über ein besonderes "compilation copyright" abzusichern. Der Haken dabei ist nur, dass Version 1.1 der GNU Free Documentation License die Verwendung von "compilation copyright" unter Punkt 7 ausdrücklich verbietet.
(6) Also soll hier eine maßgeschneiderte Lizenz zur Diskussion gestellt werden, aus dem einfachen Grunde, weil andere Lizenzen nicht benutzbar erscheinen. (Ich lasse mich nur zu gern eines Besseren belehren.)
(7) Die Open Content License (siehe http://www.opencontent.org/opl.shtml) scheint eine ziemlich direkte Umsetzung der GNU Public License vom Bereich Open Source Software in den Bereich Open Content zu sein. Sie trägt den Besonderheiten von Dokumenten nur ungenügend Rechnung. Folglich wurde von der Free Software Foundation statt dessen die GNU Free Documentation License (siehe unten) erarbeitet.
(8) Die Open Publication License (siehe http://www.opencontent.org/openpub/) versucht, das Konzept Open Content für die Tätigkeit von Verlegern annehmbar zu machen. Insbesondere durch Option B der Lizenz wird die Freiheit der Information jedoch erheblich eingeschränkt, Information wird als schützenswertes Privateigentum behandelt.
(9) Die GNU Free Documentation License (siehe http://www.gnu.org/copyleft/fdl.html) wurde von der Free Software Foundation geschrieben, um die Freie Dokumentation für Freie Software rechtlich abzusichern. Deshalb ist sie vor allem für einzelne Text-Dokumente bestimmt und sehr stark an der Produktion von Handbüchern usw. orientiert. Sie garantiert, dass ein unter dieser Lizenz erschienenes Dokument ohne Beschränkungen frei verfügbar ist und nicht privatisiert werden kann. Nichtdruckbare Metadaten werden nicht explizit erwähnt, sondern wohl als unwichtig oder als normale Textbestandteile aufgefasst. Außerdem fällt auf, dass die Lizenz keine Klauseln zur Abwehr etwaiger Gewährleistungsansprüche enthält.
(9.1) 19.05.2000, 11:57, Daniel Popescu: Die GFDL schützt den ganzen Dokumenteninhalt, also auch Metadaten. Diese müssen nicht explizit erwähnt werden.
(9.1.1) 19.05.2000, 13:24, Torsten Wöllert: Unklar wird es aber schon, wenn Metadaten über ein Dokument unabhängig vom Dokument gespeichert werden, wie das wahrscheinlich bei nicht in der DocBook DTD vorgesehenen Metadaten gemacht werden muss. Fallen die Metadaten dann auch unter die Lizenz, bilden sie ein neues Dokument?
(10) Die Nupedia Open Content License (siehe http://www.nupedia.com/license.html) wurde zwar für das Projekt einer Internet-Enzyklopädie geschaffen und lehnt sich stark an die vom Open Directory Project (siehe http://dmoz.org) verwendete Lizenz an, behandelt aber nur das "compilation copyright" an der gesamten Enzyklopädie und regelt nicht die Rechte der Autoren
(11) Die Encyclopaedia Aperta Lizenz ist in Englisch verfasst, um eine weitestmögliche Verständlichkeit zu erreichen. Übersetzungen in möglichst viele andere Sprachen sind für die Weiterverbreitung des Konzepts sehr wichtig, ähnlich wie bei der GNU Public License (GPL, siehe http://www.gnu.org/copyleft/gpl.html) sollte aber die englische Fassung die einzig rechtsverbindliche sein, um die Handhabung zu vereinfachen.
(12) Die Lizenz soll den akademischen Gepflogenheiten weitestgehend Rechnung tragen. Dazu gehört beispielsweise, dass ein Verfasser die weitere Nutzung seines Artikels zwar nicht verbieten kann, dass er sich aber sehr wohl von dieser Nutzung für alle sichtbar distanzieren kann.
(13) Dazu gehört auch, dass der Verfasser Wert auf eine ihm richtig erscheinende Einordnung seines Artikels legt, und seine Meinung diesbezüglich durchaus von der des Herausgebers abweichen kann. Die vorgeschlagene Lösung für diesen Konflikt besteht darin, wenn nötig beide Einordnungen nebeneinander abzuspeichern.
(14) Ebenso gehört dazu, dass der Verfasser auf besonderen Wunsch ihm wichtig erscheinende Teile seines Artikels vor Veränderungen schützen kann, auch wenn er sich damit um die Chance begibt, diese Teile von Fachleuten verbessern zu lassen.
(15) Um dem internationalen Charakter der Enzyklopädie Rechnung zu tragen, werden Übersetzungen der vom Verfasser geschützten Teile generell zugelassen, anders als beispielsweise in der GNU Free Documentation License, die Übersetzungen nur dann erlaubt, wenn das entsprechende Original im selben Dokument enthalten ist. Das wäre in einer Enzyklopädie nicht praktikabel.
(16) Besonderer Wert wurde darauf gelegt sicherzustellen, dass weder die Enzyklopädie noch Teile davon privatisiert werden können, ohne jedoch eine kommerzielle Nutzung auszuschließen. Insofern orientiert sich die Lizenz stark an der GNU/Linux-Praxis. Für die Struktur der Lizenz wurden dagegen Anleihen bei der Mozilla Public License gemacht.
(17) Da die Nutzbarkeit eines Nachschlagewerks ganz entscheidend von der Verbindung und Einordnung ihrer Einzelteile abhängt, erschien es ratsam, auch diesen Bereich urheberrechtlich gegen eine Privatisierung zu schützen. Dies erfolgt, indem Metadaten zu den einzelnen Artikeln anders behandelt werden als die Artikel selbst und indem ein "compilation copyright" etabliert wird.
(18) Für die Encyclopaedia Aperta License wurden, neben den oben bereits erwähnten Open Content Lizenzen, folgende Lizenzen aus dem Bereich Open Source Software ausgewertet: GNU Public License (http://www.gnu.org/copyleft/gpl.html), The BSD License (http://www.opensource.org/licenses/bsd-license.html), Open Directory License (http://dmoz.org/license.html), Mozilla Public License (http://www.mozilla.org/NPL/MPL-1.0.html), Artistic License (http://www.opensource.org/licenses/artistic-license), Q Public License (http://www.trolltech.com/qpl/), Phyton Copyright (http://www.python.org/doc/Copyright.html), The zlib/libpng License (http://www.opensource.org/licenses/zlib-license.html)
(19) Aus Elementen dieser Quellen sowie den oben genannten Überlegungen zur Respektierung akademischer Gepflogenheiten wurde die folgende Lizenz zusammengestellt.
(20) Im folgenden wird jeweils in einem Absatz der Wortlaut der Lizenz in Englisch erscheinen, gefolgt von einem Absatz mit Bemerkungen zum vorherigen Absatz in Deutsch. Diese Form soll der besseren Diskutierbarkeit dienen, weil so Kommentare sowohl zum Wortlaut der Lizenz als auch zu den Beweggründen im Zusammenhang möglich sind.
(22) ANMERKUNG: Der Klarheit wegen.
(23) ``Initial Author'' means the individual or entity owning the copyright to the Information as identified in the copyright notice.
(24) ANMERKUNG: Als deutsche Entsprechung würde ich "Verfasser" verwenden.
(25) ``Contributor'' means each entity that creates or contributes to the creation of Modifications.
(26) ANMERKUNG: Als deutsche Entsprechung könnte man "Mitwirkender" oder "Änderer" verwenden.
(26.1) mitwirken vs. ändern, 15.02.2004, 00:46, Thomas Pulina: Ich halte es für geboten Mitwirkende einerseits und Ändernde andererseits klar voneinander zu unterscheiden. Zu dieser Ansicht bin ich gekommen nachdem ich ein paar Bücher zur Entwicklung der Rechtsprechung und Auslegung des (deutschen) Urheberrechts bzw. der Urheberschaft studiert habe (etwa: Fischer/Reich (Hg.): Der Künstler und sein Recht, München 1992). Mitwirkende würde ich danach immer als MitverfasserInnen (Initial Authors) der betreffenden Informationsdarbietung ansehen. Während Ändernde immer ein abgeleitetes Werk davon erzeugen. Eine deutsch-sprachige begriffliche Entsprechung zu Contributors hab bisher noch nicht wirklich gefunden; vielleicht drückt Hinzutragende dies aus -- ist aber nicht wirklich schön.
(27) ``Original Information'' means information in Transparent Format to which the copyright and license notices described in Section 5 are attached, and which, at the time of its release under this License, is not already Covered Information governed by this License.
(28) ANMERKUNG: Als deutsche Entsprechung würde ich "Ursprungsinformation(en)" oder "Ursprungsartikel" verwenden.
(29) ``Modification'' means any addition to or deletion from the substance or structure of either the Original Information or any previous Modifications. When Covered Information is released as a series of files, a Modification is:

(32) ANMERKUNG: Als deutsche Entsprechung würde ich "Änderung" verwenden. Diese Definition bedeutet, das auch neue Artikel, die Teile eines bereits bestehenden Artikels übernehmen, als Änderung zu betrachten sind. Dadurch erstreckt sich die Gültigkeit dieser Lizenz automatisch auch auf solche neuen Artikel, es sei denn, die verwendeten Teile werden eindeutig als Zitat mit genauer Quellenangabe gekennzeichnet.
(33) ``Substantive Modification'' is defined as a change to the semantic content of the Covered Information, be it textual, graphical, or audio-visual. It excludes mere changes in format and presentation, typographical corrections, as well as translations into another human language provided Initial Author's and Contributors' names are maintained.
(34) ANMERKUNG: Als deutsche Entsprechung würde ich "Inhaltliche Änderung" verwenden. Übersetzungen sind, im Gegensatz z.B. zur GNU Free Documentation Licence, ausdrücklich davon ausgenommen, um die internationale Verbreitung zu fördern.
(34.1) 19.05.2000, 11:59, Daniel Popescu: Bei der GFDL wird es als Änderung angenommen,da man ja nicht weiß, ob die Originalintention des Textes in der Übersetzung erhalten bleibt.
(34.1.1) 19.05.2000, 13:26, Torsten Wöllert: Das stimmt. Aber die Risiken einer schlechten oder falschen Übersetzung sollten allgemein bekannt sein, so dass der Ruf des Verfassers wohl kaum darunter leiden dürfte. In vielen Fällen kann er die Qualität der Übersetzung sowieso nicht wirklich kontrollieren.
(35) ``Covered Information'' means the Original Information or Modifications or the combination of the Original Information and Modifications, in each case including portions thereof.
(36) ANMERKUNG: Als deutsche Entsprechung würde ich "Abgedeckte Information(en)" verwenden.
(37) ``Contributor Version'' means the combination of the Original Information, prior Modifications used by a Contributor, and the Modifications made by that particular Contributor.
(38) ANMERKUNG: Als deutsche Entsprechung würde ich "Geänderte Fassung" verwenden.
(39) ``Larger Work'' means a work which combines Covered Information or portions thereof with information not governed by the terms of this License.
(40) ANMERKUNG: Als deutsche Entsprechung würde ich "Umfassenderes Werk" verwenden.
(41) ``Transparent Format'' means a machine-readable format whose specification is available to the general public, whose usage is free of charge, whose contents can be viewed and edited directly and straightforwardly with generic text editors or (for images composed of pixels) generic paint programs or (for drawings, sounds and videos) some widely available editor, and that is suitable for input to text formatters or for automatic translation to a variety of formats suitable for input to text formatters. (42) ANMERKUNG: Als deutsche Entsprechung würde ich "Transparentes Format" verwenden. Zusätzlich zur GNU Free Documentation Licence wird auch gefordert, dass die Nutzung des Formats kostenlos möglich sein muss, um Lizenzgebühren wie z.B. bei GIF zu vermeiden.
(43) Examples of suitable Transparent formats include plain ASCII without markup, Texinfo input format, LaTeX input format, SGML or XML using a publicly available DTD, and standard-conforming simple HTML designed for human modification. The Covered Information can be in a compressed or archival form, provided the appropriate decompression or de-archiving software is widely available for no charge.
(43.1) 14.05.2000, 15:05, Daniel Popescu: Ich finde es sollte dann noch eine ASCII Datei dabei sein mit Downloadhinweis für das Archivierungsprogramm oder das Archivierungsprogramm sollte selber dabei sein. Außerdem müsste es freie Software sein nach FSF Definition (also nicht ZIP).
(44) ANMERKUNG: Die Zulassung von gängigen Archivformaten scheint unproblematisch zu sein. Gute Beispiele aus dem audio-visuellen Bereich werden noch gesucht.

(61.1.1) Zwei Lizenzen, 16.05.2000, 13:14, Torsten Wöllert: Ich denke, das wäre unpraktischer, schwieriger zu handhaben. Alle Artikel sollten unter der gleichen Lizenz in der Enzyklopädie laufen. Letztendlich macht das die GNU Free Documentation License ja auch so, dass sie Optionen anbietet (invariant text, cover text etc.).

Statt einzelne, stark an einer Buchausgabe orientierte Sektionen gegen inhaltliche Veränderungen zu schützen, kann der Verfasser hier den gesamten Artikel inhaltlich schützen, auch wenn das (hoffentlich) nicht die Regel sein sollte. Die in der GNU Free Documentation License beschriebenen "Invariant Sections" sind bei Artikeln einer Enzyklopädie normalerweise nicht vorhanden, außerdem heben sie sehr stark auf Englisch als Dokumentensprache ab.

(84) ANMERKUNG: Als deutsche Entsprechung würde ich "Veränderung von Metadaten" verwenden. Um sowohl den Verfasser als auch die Enzyklopädie als Nachschlagewerk vor nachlässigen oder böswilligen Verdrehungen zu schützen, indem einzelne Passagen aus dem Zusammenhang gerissen werden, wird verlangt, dass die zur Einordnung benutzten Metadaten auch bei einer weiteren Verwendung durch Dritte erhalten bleiben müssen.
